Fundraising Terms and Conditions

By signing up your organization (The “Organization”) for a True 100% Fundraiser Program (the "Fundraising Program or Fundraiser") with MyJoeCard.Com, LLC’s (“MyJoeCard.Com”) and or any associated company/business entity (“Sponsor”) that is selected to sponsor your Fundraising Program, you (“Administrator”) agree to the following terms and conditions (the "Program Terms"), in addition to the MyJoeCard.Com Website Terms of Use (Terms of Use).

Fundraising Program enables local organizations to raise money by selling MyJoeCards.  Now local schools, churches, clubs, little league teams, qualifying non-profit organizations and national foundations can raise funds without any start-up costs and receive 100% of all fundraising revenues generated from the fundraiser.

SIGNING UP:

To get started and create a Fundraising Program with MyJoeCard.Com you must complete and submit a brief form (see fundraiser registration).  All Fundraising Program applications submitted must be approved by MyJoeCard.Com. MyJoeCard.Com will notify you via email once your fundraiser is approved and will send you a link to a web page where you may download forms to organize and run your Fundraising Program.

TAXPAYER INFORMATION:

During sign-up, Administrator will be required to provide the tax identification number of the organization or person that will be the recipients of proceeds from the fundraiser. Administrator will also be asked to indicate the tax exempt status of the organization, which will be used to ensure that the fundraiser proceeds are delivered to the organization intended to receive the funds. If the entity that receives funds from the fundraiser is not a tax-exempt organization identified in Section 501(c)(3) of the Internal Revenue Code, MyJoeCard.Com may send a Form 1099-MISC to such entity pursuant to applicable Internal Revenue Service guidelines.

MISCELLANEOUS:  

You represent and warrant that (i) your registering a fundraiser with MyJoeCard.Com does not violate the rights of any third parties and complies with all applicable federal, state and local laws and regulations, (ii) you are an authorized representative of the organization for which you are registering a fundraiser with MyJoeCard.Com, and you are authorized to bind the organization to these Program Terms, (iii) if you are registering your fundraiser on behalf of a third party you represent and warrant that you have permission and the authority from such third party to do so, and (iv) any and all information provided in the sign up form, including without limitation the organization's tax identification number, is true and correct. Administrator may participate in only one fundraiser at a time.  You understand and agree that MyJoeCard.Com has no obligations in connection with the fundraiser other than those set forth in these Program Terms. You also agree that you will receive marketing and other electronic communications from MyJoeCard.Com associated with your fundraiser. For example, you may receive emails containing helpful tips on how to manage your fundraiser. MyJoeCard.Com reserves the right to reject an application by any organization to participate in the Fundraising Program for any or no reason. For avoidance of doubt, these Program Terms are in addition to, not in lieu of, the Terms of Use listed at www.myjoecard.com, therefore your registration of and participation in any fundraiser is subject to both these Program Terms and the Terms of Use.

OWNERSHIP:

Administrator acknowledges that MyJoeCard.Com, LLC owns all rights to the products and services supplied through the MyJoeCard.Com website, including the website itself. These rights may not be transferred or resold by the Administrator or Organization. Marketing Materials supplied by MyJoeCard.Com,LLC or available for download on the MyJoeCard.Com website are the exclusive property of MyJoeCard.Com, LLC and may be used only in conjunction with an active fundraising campaign being run through the MyJoeCard.Com website. All editorial content and images on the MyJoeCard.Com website remain the exclusive property of MyJoeCard.Com and may not be copied, distributed or reproduced in any form without the express written consent of MyJoeCard.Com. Third party products and services listed on the MyJoeCard.Com website belong to the manufacturers of those products or purveyor of those services.

ACCEPTABLE USE

MyJoeCard.Com is committed to responsible use of its web site and email, and operates in full compliance with the Can-Spam Act of 2003. Emails generated through the MyJoeCard.Com website on behalf of an Organization are also subject to the rules of this legislation. Under the Can-Spam Act of 2003 and subsequent amendments you have the right to refuse to accept e-mail advertisements. If you do not desire to receive e-mail advertisements, please e-mail us at cs@myjoecard.com with the subject title ‘remove’.  Once we receive your request, please allow ten (10) days for your e-mail address to be de-listed from our system.

ADMINISTRATOR COVENANTS:

Administrator agrees not to directly or indirectly modify, alter or copy any portion of the MyJoeCard.Com website, nor to attempt to decode and/or reverse engineer the source code powering the MyJoeCard.Com website.

Administrator agrees to provide all required documentation and/or data, paperwork, and any receipts required by the Fundraising program.  Administrator agrees that any data provided to MyJoeCard.Com must be in an acceptable format, as determined by MyJoeCard.Com.

Administrator assumes all expenses incurred by MyJoeCard.Com should the Administrator terminate the campaign before the start date or fail to provide required fundraising documentation including all participant contact information required for all prize drawings and registrations. These expenses may include but are not limited to charges incurred for the preparation of any additional marketing materials ordered by administrator, pick-up and/or delivery charges for fundraiser products or materials and labor charges related to the program set up process.

SPONSOR COVENANTS: 

Sponsor agrees to provide sufficient logo branded MyJoeCards - the fundraising products (MyJoeCards) for the Fundraising Program for Administrator’s Organization.  Sponsor agrees that any and all use of any MyJoeCard.Com product (I.e. MyJoeCards) shall only be used, transferred, sold, distributed, or handled only in accordance of MyJoeCard.Com’s Terms of Use. 

Any decisions to participate in any giveaways, contests, and prize drawings by Sponsor and/or any gifts and prizes pledged and/or provided by Sponsor in conjunction with the Fundraising Program for the Organization are at the sole discretion of Sponsor and as such are the sole responsibility of Sponsor.  Any and all costs incurred, purchases made, or products and services pledged by Sponsor for any giveaways, contests, and prize drawings for Organization shall be at the sole expense of Sponsor.

Sponsor agrees that any information gathered or received in conjunction with any MyJoeCard.Com service, product or program, shall be property of MyJoeCard.Com and may be made available Sponsor only, and shall not be shared with any third parties.

MYJOECARD.COM COVENANTS:

MyJoeCard.Com agrees to provide the fundraising products (MyJoeCards) for Applicants fundraising campaign at no cost.  MyJoeCard.Com agrees that ALL proceeds generated by the Fundraising program will go to the Fundraiser’s Cause.  Provide MyJoeCard samples (one each) for students, teachers, and volunteers. Provide online order forms, checklists, sales tracking sheets, and information.  Provide a plan for a “Brainstorming” to generate cash, prizes, and incentives for your group!

MyJoeCard.Com will help select a qualifying Business Member to be the Sponsor for your fundraiser. See our "Selecting A Sponsor" page, or suggest/refer a local business to be your fundraiser sponsor.  Help the Sponsor choose any prizes for a drawing (if applicable) for your fundraiser.  Help make arrangements for pickup and/or delivery of fundraising products and/or prizes by coordinating with the Sponsor. Help the Sponsor to have a drawing for the prizes that they donate for the fundraiser. Notify all participants registered for the drawing of the winning 16 Digit MyJoeCard Number!

Note: Any additional services such as online payment processing (coming soon!) or delivery/shipping of cash, prizes, and incentives performed by MyJoeCard.Com, LLC may include a fee for processing or shipping & handling.  Unless otherwise notified, any proceeds or checks processed and/or handled by MyJoeCard.Com will be issued to the Administrator and mailed via U.S. Postal Service to the Organization address provided by the Administrator.  Checks that are not cashed within 90 days of issuance will be cancelled and a replacement check will be issued only upon request by the Administrator or other authorized representative of the Organization. Replacement checks will be issued within 30 days of the request.  Administrator and Sponsor acknowledges that any orders sent through, received, handled, or processed by the MyJoeCard.Com or The MyJoeCard.Com website will be subject to processing and shipping and handling fees.

Any proceeds/checks for fundraising campaigns terminated between the 1st and 15th of the month will be issued on the first business day following the last calendar day of the month.

Any proceeds/checks for fundraising campaigns terminated between the 16th and the last calendar day of the month will be issued on the first business day following 15th of the following month.

LIABILITY AND DISCLAIMERS:

MyJoeCard.Com makes no guarantee of any kind, express or implied, as to the level of success or amount of funds raised for any fundraising campaign. MyJoeCard.Com also makes no warranty, representation or covenant, express or implied that your participation in a fundraising campaign will comply with state, federal or local laws that apply to your Organization. By using the MyJoeCard.Com website, the Organization certifies that it is in compliance with state, federal and local laws that apply to the Organization. By use of the MyJoeCard.Com website, the Administrator and Organization, and any successors or assigns of the Organization agree to indemnify and hold MyJoeCard.Com harmless from any damages, liabilities or losses resulting directly or indirectly from the use of the MyJoeCard.Com website.

CONFIDENTIALITY:

In order to use the features of the MyJoeCard.Com website, some personal information will be collected from Administrators and members of the Organization. MyJoeCard.Com will also collect information about locations on the MyJoeCard.Com website visited or features of the MyJoeCard.Com website used during the fundraising campaign. Information collected at the website and during the Fundraising Program will be used to process transactions and operate the Organization’s fundraising campaign.

All information collected is considered private and confidential as is treated as such.

Any information supplied by participants for the fundraiser and with regard to any registrations for drawings for prizes supplied by MyJoeCard.Com and/or Sponsors will only be used by MyJoeCard.Com and the partnering Business Member who is the Sponsor for the Fundraising Program, and will not be shared with any third parties.  Please refer to the MyJoeCard.Com Privacy Policy for more information about Confidentiality, Privacy and Security.

TERMINATION:

This agreement is binding until the end of the Organization’s fundraising campaign. A campaign ends when the Administrator terminates the campaign through the "cash out" process or after 2 weeks of inactivity by the Administrator or any member of the associated organization. MyJoeCard.Com reserves the right to terminate this agreement at any time if the Administrator or Organization violates any tenet of this agreement or the MyJoeCard.Com Privacy Policy or Terms of Use.

Use of this website is governed by the laws of the State of Kansas.  Use of this website mean the Organization agrees to the Privacy Policy, Terms of Use, and to the MyJoeCard.Com Fundraising Terms of Use as stated herein and as subsequently amended.
